Hello

I'll try to keep this short and sweet, NC due to being outing.

I left a job after maternity leave, when they offered me half of my contracted hours and a lesser position, because "[name] has your job"

I told them I wouldn't be coming back to that role and asked if could do another, that suited my competencies or y'know, my actual contracted role. I was told to apply for my job from scratch?

I asked for a reference, the manager didn't give one.

I asked for a p45, we're now almost 2 years on and they won't give me one. I received a p60?

My DH thinks they've claimed furlough for me and kept me, but how would I know this?

I never did anything at the time due to post natal depression and quite frankly, it was all too much being told I had no job, and would have to do admin 15 hours a week as opposed to my managerial 40 hours a week

Because I chose to have 9 months mat leave? Which I think pissed them off, they rang me weekly to ask if I would come back sooner

I did formally resign via email and WhatsApp (as instructed by manager)

You need to try and get some legal advice. What they did by not offering you your original job after maternity leave was illegal. Withholding P45 is bad not sure of the legalities. Could you ask your local tax office for advice?

Thanks, I have an appt with the CAB but im also thinking, it's in the past just let it go

If they've claimed furlough without paying you 80% of salary that's fraud - does the p60 match up with what you've been paid?

How long ago did you resign? It’s blatant sex discrimination not to allow you to return to an equivalent role but claims need to be brought within 3 months

Well it sounds very much like they beached employment law over your return to work, but if it has been a couple of years you are time barred now and I would leave it alone.

When was your final day of employment as far as you are concerned? When did you get the P60? If you left around April, it isn’t inconceivable that you would get a P60 and obviously you should have got a P45 but it could have gone astray and it isn’t possible to reproduce one.

I sort of doubt that they would have claimed government job retention scheme grant for you. They would have to disclose the NI number of the employee when they claimed, so to avoid being detected they would have also needed to generate a payslip for you and pay over tax on NI on your behalf. You could go online and see if that happened?

There is a box on the opening page that is there telling you if an Employer has made claims.

Also another telling sign is if pension contributions continued after leaving employment.
