Getting Preganabt on Maternity Leave

LEMONADEGIRL · 14/12/2007 21:24

Just wondered if anyone could answer this query for me.

A friend of mine is on maternity leave she is due back to work in Feb. She and her dh are planning the second and she hopes to be pregnant before returning back to work. However, will she still be entitled to maternity pay for the second leave. As she will not have worked there for a year on return.

She has worked at the same company for five years.

I think that she will be entitled to maternity pay as she is still employed by the company therefore should have the same rights as anyone who is at work.

I'm no expert though - just going on experience with colleagues.

thanks sophierose that is my opinion too, but as am no expert wanted to see what others thought too.

You don't have to work a year after the first maternity leave in order to qualify for the second maternity leave. I know people in my [ex] office have come back already pregnant.

She has all her rights in terms of maternity leave but may not be entitled to any pay unless she is on an enhanced company maternity pay - see here, the basic statutory pay is worked out based on average earnings during a qualifying period, so she wouldn't get any pay on that basis.

flowery. Is there a limit to how many times a woman can come back from and go on maternity leave again? Extreme example is if a woman came back form and then went on, say...four times? Would an employer need to find mat cover each time ad infinitum?

flowerytaleofNewYork · 14/12/2007 22:39

lemonadegirl ignore me, depending on her timings she may get maternity pay, for some reason my brain was assuming she wouldn't go back before going off again, but as long as she's there at the right time, have a look at the link, she will get paid.

Bubble no limit, no, as long as the criteria are met each time for pay as per the link, a woman can (and indeed some do!) spend years being at work for about 5 minutes at a time.

I was 12 weeks weeks pg with DS2 when I went back to work after 10 months mat leave with DS1. I got full mat leave and pay again. It depends on how far along you are, as flowery said it depends on your average earnings based on a qualifying period and I was able to complete the qualifying period.

Some companies insist you are back at work for one year, or even two, before you are entitled to their enhanced schemes.

Hi foxy. Good to see you. x
