maternity leave and holiday pay.help needed please

i finished work to start maternity leave at the end of february this year.i have taken extended leave and am due back march 08.i am entitled to 20 days holiday a year.i took the 12 flexible days as i have to save 8 for bank holidays and christmas.now my boss is telling me i have to pay back the money i have been paid for the holidays i have already taken . is this right? i am not intending to return to work but haven't handed in my notice yet.can anyone help me?

slb you are entitled to accrue holiday during all your maternity leave so you don't have to pay anything back and should make sure you get paid for the bank holidays that happened while you were on maternity leave as well.

If your job is full time you should by law now get 24 days holiday each year, including bank holidays, from last October, so if your job is full time, make sure you get that as well.

thank you so much.i have just spoken to my boss and yes they do owe me money,however she did say that i am only to 20 days not 24.i have also given notice over the phone to be followed up by letter!i am shaking.i'm freeeeeeeeeee

Do push it with the 24 days not 20. From 1st October when this ruling came in to the end of your mat leave is 5 months. It's 4 days extra a year so over 5 months thats 4 / 12 x 5 which I work out to be an extra 1.67 days you should get. It's also important from the point of view of your boss being aware of the new rules for other staff to make sure they don't lose out. Do show her the link I gave you if there are any problems with this.
