What happens if you leave your job but have taken more than your entitled holiday in that period?

Bit of a random question, but say I get 21 days holiday, which is 1.75 days per month, if I were to leave my job say in March (holiday period starts in January) so really my allocated holidays should of been About 5 days, if I have taken 10 days off in that time, what happens?

I know that if you are owed holiday during your notice period they either have to pay you for the holiday or let you take the holiday, but what happens if it's the other way round? Nothing?

They dock your end pay

Silkieschickens · 13/10/2021 09:53

They would take the extra 5 days off your pay

TheGoodEnoughWife · 13/10/2021 09:53

They ask for the money back. Depends where you were working probably but my daughter left Asda having taken more holiday than she was owed and they ask for money to be paid to them.

They deduct any holiday that isn’t entitled.

HunterHearstHelmsley · 13/10/2021 09:54

You have to pay them back. If you are owed 4 weeks pay, and you owe them 1 weeks holiday, you'd be paid for 3 weeks effectively.

CaddieDawg · 13/10/2021 09:55

They'd normally take it back from final pay, so long as the contract allows it (which 9/10 it will, it's a fairly standard t&c). So you'll effectively work the days back during your notice

I'm afraid this happened to me recently when I left my job. I was granted 2 weeks holiday, and then resigned, using the 2 weeks as my notice period.
Turned out I was over my accrued holiday allowance, and they didn't pay me. So that was a nice surprise Hmm

Normally the policy would be that you have to pay them for any excess holiday taken (in the same way that they’d pay you if you hadn’t taken it). I had this when I left a job 4 months into the leave year, having taken more than half of the annual amount.

Thanks all, this makes sense! Unfortunate as I'll probably only take more days off than usual because of interviews 🤣

Didn't you realise you'd taken more leave than you've accrued?
BashfulClam · 13/10/2021 21:00

I was told in my notice period that I owed 3 days holiday back. That was fine an dm it was deducted from my wages, conversely if you haven’t taken enough they will pay you.

This happened to me and I had to pay some money back.
