Hi,

I’m new here and need some advice - can you be force you to take sick leave even though your not sick - your GP and care team have no issue with you working, there is no concerns about your work, your direct line manager has no concerns about you or your work however a senior manager has decided that they are concerned for my well being and want occupational health to clear me before returning to work
I want to return
I hope that makes sense

Why are you off sick? Is it a disability as defined by the equality act? Could be why your employer is wanting OH. The reason would be so that they can make resizable adjustments following an assessment, and prevent any likelihood of you not being properly rehabilitated for work/ them being sued

I’m not sick, my employer has done it because I have a mental health condition which is well managed however is concerned for my well-being even though my mental health care team have no such concerns nor does my direct line manager

A mental health issue can be classified as a disability under the equality act. I highly suspect this to be the case. If you elaborate I/ others may be able to help further steer

I had a situation recently where i thought a member of my team was not fit for work - it seems that if you say you’re fit for work you’re fit for work and your employer has to accept that.

Do you have an issue with being “cleared” by occ health? Will they give you the time off between then and now paid without impunity e.g sick warnings? If so I’d just go with it, sounds like it would be a formality. If you won’t get paid or they will count it toward trigger points I’d make an almighty fuss!
