TTC while on secondment- maternity pay advice - help!

Hi

Question, me and my husband are thinking of TTC soon this year, however I have worries about my job. I have been with local authority for over 4 years now in the same position, that position I have been permanent for around 3 years and prior to that I was on a fixed term contract in the same job until I secured it permanently. So let’s say the permanent job is job A. I have been in new job B on a secondment since January with the same local authority just a different department and I am seconded in that position until end of this year 2021.

I have spoken to my new manager in job B and they are very happy with my performance and is finding out if they can secure funding to make the post permanent before the end of secondment and would want me to go permanent is that’s a possibility. I am full time.

My questions are 1.. if me and my husband are successful in conceiving during my secondment then it goes permanent and I apply, assuming I am in my sage period and tell my manager can they discriminate against that and end my secondment as the original plan at the end of the year so I go back to job A? Even though they are happy with my performance ?

And second question is 2. Assuming I fall pregnant tell my manager or not depending on when I pass my sage 12 week period, say I get the job permanently, will I then be entitled to full pay maternity leave on the new jobs salary ? Even though I will have been in the new position for about 10 months but technically permanently employed by the same employer for over 3.5 years ? I know it might sound silly but I didn’t know if you had to have been permanently working in a new position for a certain amount of time whilst being permanent for example working your new notice period etc.? But like I said I have been with the same authority for a few years in my job A on a permanent basis.

For reference my employer does pay full salary based maternity leave not just statutory.

Basically the main thing I want to know is if I get taken on permanently in my new position and I then tell them I am pregnant whether that be beforehand or after I secure permanent will I then get the full new jobs salary maternity leave ?

Sorry for the ramble I have so many questions in my mind and I feel like my job is dictating my decision of when to try for a baby.
I can survive on my job A already permanent position salary, however of course I would like to secure a permanent position in my secondment role as it’s more money, and I wish to return to work after having a baby should I be lucky enough to fall pregnant.

Any advice will be grateful.

  1. I’m not sure what you mean by your “sage period” but your employer can’t discriminate against you because of being pregnant so if they would otherwise be either extending your secondment or making you permanent, they can’t change that decision because of your pregnancy/maternity leave. It can’t be a factor.
  1. You’ll need to check the wording of your maternity policy. “Full pay” would normally be the pay you are on at the time your leave starts but it’s possible your employer has wording indicating differently.

For SMP you use the 8 week period prior to the 15th week before your due date. Occupational mat pay usually uses the same period because it is paid as a top up to SMP. However, you do need to check with your HR.

I was pregnant on secondment and received the maternity pay associated with my secondment salary as my secondment contract covered the duration of my maternity.
