SSP how to claim?

grumpydwarf · 16/03/2021 22:35

I recently had to take 5 days off work sick due to a miscarriage. My boss has always refused to pay sick pay and also SSP. I have worked at my company for 5 years and am hourly paid on 27 hours per week over 5 days.
Gov websites say I'm entitled to SSP from day 3 but my boss didn't pay it in my wages. I submitted a self cert and gave it to her hoping she would then put in writing that she won't pay it so I can pursue via HMRC but she hasn't yet. To complicate things I have put in my notice and leave in 3 weeks. What can I do to claim the SSP due for those 2 days? Tia

Firstly I’m sorry to hear about your loss Flowers

Your employer legally has to pay you SSP, it isn’t a choice. I would stand your ground with this as she is breaking the law by not paying - www.acas.org.uk/checking-sick-pay/statutory-sick-pay-ssp

Sorry for your loss.

Ask your employer for an SSP1, if they are not paying SSP they should give you this form. Do this in writing and make them respond in writing.

If they won’t pay it, contact DWP and ask their advice.
