2 month notice period

Hi

This is probably a stupid question but I have a 2 month notice period (NHS) and will hopefully have a start date for my new role soon, and so will have to give notice.

It’s a 2 month notice period but I’m confused as to whether that means 2 calendar months or 8 weeks . My contract just says 2 months.

I’d take 2 months as if I resigned today 26/02/21 then my last working day would be 26/04/21 but this doesn’t seem right.

The likelihood is I’ll give slightly more notice because I will resign 2 months from the following Monday.

Also, do I have to physically print off a letter of resignation? When I resigned from my last nhs job I just sent it by email but I’m unsure this time round. Thanks

Usual legal meaning is a calendar month unless there are specific interpretation provisions in your employment contract. So yes your interpretation should be correct.

Sorry just to add I can't see why notice by email isn't enough. There's a fair bit of guidance on the law commission website on electronic notices and contracts so that should be fine. Again, your actual contract may say physical delivery of the notice but I suspect that's unusual these days - am not an employment lawyer though.

If it says months it will be calendar months, if it were 8 weeks your notice would be stated in weeks

I’ve just read my contract again and the footnote says month = calendar month so that’s fine.

I’ve received everything from the trust via email and the contract doesn’t state either way so I will email my notice when the time comes. My manager is aware that I’m leaving so it shouldn’t be a surprise
