SMP Qualification

Hey :)

Hoping someone might be able to clear this up for me as it's giving me sleepless nights!

I was furloughed back in March, went through a consultation, and agreed to take part time hours as an alternative to redundancy. In July I started working on a casual basis two days a week for another organisation, as well as continuing to be furloughed by my original employer.

The organisation I started working with in July offered me a full time role two weeks ago which I accepted. I then put my notice in to my other employer last week, only to find out that same night that I'm 5 weeks pregnant.

I'm now furiously completing every on line calculator to work out what this will mean for maternity leave and pay next summer. The main confusion seems to be that although my continuity with my 'new' employer dates from early July 2020, my status has changed from 'worker' to 'employee', and now I have now idea what I'll be entitled to. Any advice would be hugely appreciated - although this baby is a surprise we are delighted, but this worry is getting in the way of me being able to get properly excited!

For the purposes of SMP if you’ve been working continuously since July it won’t matter that for part of that you were described as a worker rather than an employee.

You need to be with an employer 1 week longer than weeks pregnant you are to qualify for SMP, but from the sounds of things you will qualify for Maternity allowance that you claim direct from HMRC.

Sorry you have been with the same employer as longer as you were on PAYE you will qualify for SMP.
