Agency and Xmas hols

Just wondering if anyone knows if this is allowed? My husband is employed in a warehouse via an agency, he's been there since July. He requested two days holiday over the Christmas period and at the time was told he'd have to 'wait and see' and then about a week later he was refused them as Xmas is a busy period.

Today one of the men he works with has requested the same days as my DH did and he has been granted them as he is a direct employee not agency.

Are they allowed to do this? This seems like total discrimination against an agency worker in favour of a direct employee.

Yes they are allowed to do that. Agency workers do have some protection in respect of basic terms such as pay rates, that type of thing. But managing holiday requests doesn’t come into it I’m afraid.
