Mat Leave overlapping Annual Leave

Hi all,

Whilst pregnant, I was required to take outstanding annual leave prior to starting maternity leave.

The annual leave dates were 5th - 12th August (inclusive).
However, my baby arrived earlier than expected on 10th Aug.
This obviously automatically triggered the start of maternity leave which was confirmed in writing as the 10th of August.

So my question is:
Am I not entitled to 3 days annual leave (10th - 12th Aug) that ended up being replaced with mat leave?

Please correct me if I’m wrong!

I think you'd be able to carry it over and use it before you return to work. Speak to hr and if you don't get a resolution then acas/union is your next option

You should get your annual leave back. Contact HR to clarify.

Yes you’ll have to take those days another time.
