Redundancy - criteria changed in middle of process with no consultation??

My employer commenced a redundancy process based on the set criteria in the handbook.

I flagged up that as the company cancelled all performance reviews for people on furlough it was unfair to use it in the process.

My employer has now removed that specific criteria without saying a word or consulting anyone!

What do you think to that??

Also I had a thought today the initial furlough period was 3 months and they never came back and asked for agreement for the other 3. Is this allowed?

You complained about performance being included, so they removed it, and now you’re outraged that it was removed? Confused

What did you want them to do?

With the furlough, depends what it says in the agreement but I imagine they could argue that people had agreed by signing the first agreement and the situation continuing.

You could go back and argue that you didn’t agree to be furloughed, but you didn’t show up for work, presumably, or make any attempt to do so?

So you know that consultation is not negotiation, right?

It basically means the employer taking your views into consideration before they make/confirm decisions. Which they did.

I have no objection with them removing it but it just seems odd not to say a word about removing it to all the staff ??

I am aware it’s not a negotiation. Being on furlough the communication has been bad that’s all

Agree comms are poor. They may update verbally at the next consultation meeting.
