I have had 4 mtgs with HR either by phone or in person. I have now had 2 mtgs with my mngr, HR, District mngr, and HR director all at the same time. I have stated clearly what is going on with facts and they all acting like they are not, in any way the problem. everytime I have a mtg things just keep getting worse for me. this last week I took A week off to try and heal my mental, emotional well being, today is my last day off and HR is already left me a msg wanting to know if I can be a team player now. How do I resond to that? What do I need to rite in this letter ?

Completely depends on what the issues are, and what your protected characteristics are.

I filed a wage complaint with labor standards. Only after my mngr said most of my missng pay is from dates that HR said were to far back and then no other response. Im 52. After I filed my complaint I started getting unequal writes ups. I believe its age discrimination and retalliation and its consistantly getting worse.

Other than explaining what you think the problem is and why you are unhappy with the responses given, nobody could possible tell you what to write when they know nothing about the situation or what had been said to you.

I guess my question would be, if you have spoken to all those people so many times, what do you think a letter will do? And are you absolutely sure that you are right? Some organisations simply don't deal with stuff no matter what you say, but if they are actually provably breaking the law on such matters, why would such senior managers ignore you? It does happen that unfair stuff happens but it isn't legally unfair - could that be the case for you?

What country are you in, OP? The law can vary.

Are you in the US? Labor Standards complaints are US law I think?

I have gotten a write up for creating a hostile work environment because I snapped at my coworker, 13yrs younger, who was 30 min late and being a brat(nice word) and so she said I was being mean. She was trashing an area I had just cleaned and I told her to knock it off. That was it. I have watched other coworkers yell, cuss, throw sissors and nearly hitting another girl, stomp around, make coworkers cry, made a new girl quit for being treated badly and none of them got write ups at all. My mngr has told me our uniform pants are now only 1 color instead of 3. Thats was untrue. I work graveyard in a c-store and we have always had doorbells on all 3 doors so we are aware when people enter or exit. My mngr told me that HR says they are not allowed so now my safety is an issue. I work alone and its a very high crime area. Allegations are made about me to HR or my mngr and instead of watching the store video for the truth HR comes at me confronting me and wanting to know why I had these things. I get upset/ mad and tell them to watch video for the truth. Theu come back with other things they have made up. Several emplyees have quit because of the lies. I have migraines due to the constant stress and when I call off work because of a migraine they have told me I have to have a valid excuse to call off. Theres alot more but its all pretty much the same type of stuff its just non stop lately. I want to write a proper letter/ complaint so. Its on the record per say. Its like they think the harassment will make me forget whats really happening.

Have you raised a formal grievance? What have been the agreed outcomes of your meetings?

I think thats what the letter is for. ? The store now has a security guy but, when people come in the store, he goes outside. That does not do me any good. And now they have told me I am not allowed to call the police unless my life is in jeopardy. As far as the outcomes where we stand right now is they want to have me sign a performance Improvement plan which I have told them I choose not to sign it because I don't agree with it.

Well in that case you need to post on a US forum. Most of us here are British, the laws are completely different.

Sorry. Everything I know about the US and labour law says that you haven't a hope in hell. You have no protections in the way that we do in the UK, or elsewhere in Europe. Find another job. They have made it clear that you are on the road out of the door, and going under your own steam before you are dismissed would be much easier on you.

Unfortunately, in the USA, most of the laws are non-existent!
AriettyHomily · 30/07/2020 15:26

You are going to have completely different laws to here, but to be honest, you sound like a bit of a nightmare. If you have co workers how do you work alone?

daisychain01 · 30/07/2020 17:41

Although you have self-assessed the discriminatory elements of your grievance, you need these to be validated with a US employment legal expert, because ones own perception of what constitutes discrimination isn't always the reality.

PerpendicularVincent · 03/08/2020 20:28

You need to post on either Askamanager or in the 'Work' or 'AskHR' sections of Reddit.

They're both US websites and will give far more relevant advice. Is Colorado an at will state?
