Employer not paying tax etc

8 replies

I had it confirmed today that my employer hasn't paid my tax or national insurance for most of last year. I have been asking for a P60 for ages but not received so had an inkling something was wrong. I am now worried about everything - job security (especially at the moment), HMRC etc. So stressed. What can I do?

Have you been paid cash in hand then or bank transfer? Do you have any paperwork showing what you have been paid or your salary/hourly rate?

Bank transfer. Salary agreed in contract.

But seems now company changed names - or more appropriately one company closed and another opened although was never notified of this. Salary stilll coming from same account but potentially this voids my contract? Am I just really stupid?

Is the contract an employment contract or a contract for services? As in, are you an employee or a service contractor?

Follow on question - is it a limited company- ie one you could check on companies house to see if it’s been name changed or phoenixed?

Don't you get wage slips at all? Who or how was it confirmed tax hadn't been paid?

This happened to my DP when working through an agency, he was getting payslips showing deductions but they weren’t passing on to HMRC. He was contacted by HMRC about making up missing NI contributions, sent all payslips to HMRC who then went onto to prosecute the company.

@worriedEmployee

As PP said - you either contact HMRC directly by the phone and inquire about it or register personal tax account online:

www.gov.uk/personal-tax-account

This account shows all of you employments, income tax and NI paid for previous tax years. Then you can compare information with your payslips.
