Changing jobs while on maternity leave

I've decided that I really don't want to go back to my current job so I'm job hunting while on maternity leave. I know it's probably different with each company but I'm wondering what the general rule is regarding taking maternity leave but not going back to work. Do you have to pay back any money or go back and work a notice period?

Unless they pay over and above SMP and state beforehand in writing that this extra is conditional upon your return for a specified minimum period , it is yours to keep. SMP and cash in lieu of contractural benefits is yours regardless. You have to let them know and resign at least a month (or your notiuce period) before you are due to return.
