Forced to resign

Hi all

I am very upset so I'm sorry.😢
Yesterday I had to resign from my nhs job role. Work were not understanding the fact I have 2 children under 16 that have medical needs. I had meetings upon meetings with the nursing director and still I couldn't get anywhere with him.
I told him I'm a single parent to 2 vulnerable children and all I was told was "why can't they go to school"- my answer was "because I live 45 min away, I don't drive, I rely on public transport. Then I was asked "why can't family members look after them" - my answer was haven't you heard the guidelines. I cannot take them to my dads because he has I'll health, I don't speak with my mum and further more there dad is also isolating because he has covid" nursing director then said to me it was my problem and I need to sort it out and find childcare because he expects me back to work doing my contracted hours )bearing in mind they are 12 hour shifts)..I've contacted my GP and they only told me to go on gov website which I done like 10 times and filled in the form for shielding.
Before all this lockdown and coronavirus I had every planned out, childcare was in place, everything. Now I had to resign from a job that I adore and love.

I'm sorry if I'm going on I'm so upset.

Did I do the right thing.

Are you in the union? I'd also speak to HR not just the nursing director.

Can you not be furloughed? Sorry I'm not sure if it applies to NHS workers.

I don't recall being in a union. And no furlough doesn't apply to nhs staff

How did you usually manage school and working?

Do your children qualify for the shielding list?

Well it doesn't matter what they do normally, because these aren't normal times! There must be others in the NHS in the same position, OP. I think you should call HR, tell them you are withdrawing your resignation as you were bullied into it. Then get onto ACAS and ask for their advice.

What were you asking for? Paid leave? You'll know if you're in a union as you'll be paying them.

It's probably too late but if you're resignation hasn't been accepted could you be asked to be redeployed to work on the vulnerable adults helpline? Your CCG should run it and in my area it can be done from home and they're desperate for people in my CCG.

I've done everything. I've spoken to HR. They won't redeploy me as I have no childcare. And they have nowhere for me to go

As for my post I did state that my child care and everything was all fine until covid got in the way.

According to my doctors yes they do but they are not sending letters

No I wasn't asking for paid leave! And no I'm not in a union then. I was asking for unpaid leave but they say my Bradford score has gone up since March 23rd!

I think I would speak to my MP over this. It's grossly unfair that you have to leave your job.

So do you travel 45 minutes to school and back twice a day by public transport?

Yeah that's my next step and to speak with cab. I've been there 2 and half years. And my attendance is normally good unless I have an emergency with the children

Could you ask for a keyworker place at a closer school? Though school hours wouldn't cover your shifts anyway would they?

Yes myself or my partner would do the 45 min journey.
Local schools around my area didn't accept my children and I appealed against it 5 times and got declined 5 times

It’s really tricky as Nhs in these times.

I’ve needed to be at work way more than normal and on multiple layer shadow Rita’s for on call in case they person down falls ill.

It appears unacceptable to say you can’t do x or y because of child care and any time off is unpaid at best.

Flies straight in the face of other public service workers who appear to be ok to be at home as there’s ‘no one to look after our kids’

I either come in or they sack me.

It is a tricky one as like I said in my post. At this moment in time I have no1 to look after my children. Even if I was still working I won't be able to come back home to my children as I would have to isolate

You're entitled to request unpaid parental leave. It's a statutory right.
Up to 18 weeks leave for each child up to their 18th birthday. Limited to 4 weeks per child.you need to give 21 days notice to take it though.

I think more and more people are about to face this op. It’s made doubly complex because you resigned, they did not terminate your employment.

Ultimately an employee has it be available for work. There is no protection if they are unable to do so because of caring responsibilities

This is made more complex because you walked before you were pushed. It is fine for him to tell you after repeated absences you’re expected to be available for work. Your response of resigning really puts it back to you

I’m not sure much could be done here, ultimately because you resigned.

Are you a registered nurse. The RCN can offer advice or ACAS. Did you get any warnings that you might lose your job or back to work interviews after being off sick. Do your dc qualify for school transport or taxi if they have medical needs. Would it help to speak to occy health.

No we haven't been given any advice on transport for the children. The school say they don't have funds for this. I will speak with cab tomorrow
