Furlough but have to work

Posting for DH. His employer has said everyone is now on furlough and has stated that if staff want to work that it is voluntary.

The problem is DH’s job is regulated and he has legal obligations that he has to fulfill to set deadlines (hope that makes sense) otherwise he could lose his practice certificate. All this can be done from home and DH has the ability to do this.

Should his employer be paying his full wage considering he has to do and is able to do the work?

Yes he should be being paid. You can't work at all if you are furloughed. We have been told not to reply to any work emails.atball whilst we are furloughed as it breaks the rules.

They can either furlough him or pay him to work. They can’t do both.

And if his work is there, he can’t be furloughed.

This is what we thought. So he is right to go back and say as he has to work to cover his legal obligations he is expecting to be paid full pay

He should respond saying that as his work is still there and he needs to continue working and is able to do so, he is not eligible for the furlough and does not consent to the proposed variation in his terms and conditions.
