Redundancy- annual leave

liloleme · 25/02/2020 21:01

My Dp has been made redundant and has been told he must use any annual leave accrued during his garden leave or he will lose it and not be paid for it.

Is it right that he won't be paid if he doesn't use it?

TIA

Employees continue to accrue holiday during garden leave, even though they are not attending work. Employees can be required to take holiday during their notice period, but when calculating they need to include holiday accrued to their actual termination date.

They can require him to take it, as long as they give twice as much notice as the holiday they require him to take. So if they want him to use a week’s holiday, they need to give him two weeks’ notice.

Thank you both. Smile
