Working under my contracted hours

I'm a retail supervisor and have been getting under my contracted hours. My contract says "Your normal hours of work are 37.5 hours per week with an unpaid break of 30 minutes
if working 6+ hours per day, or 1 hour if working 7+ hours per day. These normal hoursÂ*of work may be varied to meet the needs of the business." but I have been getting 25-30 hours a week. Where do I stand on this? I have been going months and months being under paid.

A good starting point would be to speak to the person who allocates your hours and tell them you should be doing 37.5 hours every week.

This sentence is your problem ”These normal hours of work may be varied to meet the needs of the business.“

You could argue that the clause doesn’t allow a permanent or frequent or ongoing variation and that 37.5 should remain ‘normal’ but it’s not a solid argument I’m afraid. Particularly if you only raise it months down the line.

However I still think you should bring it up and say your hours should be normally 37.5 and ask why this isn’t happening.

Do you think the hours are available but just aren’t being given to you?
