Hi, I was hoping there might be an employment lawyer able to help me with an employee resignation issue.

I’m not a lawyer but I am an HR consultant and can probably help you, what’s the issue?

I’m afraid not. Can you leave out/change details?

Basically a recently hired employee gave informal notice to leave. I accepted with immediate effect but failed to notice a second email with offer of working notice. Basically they want to be paid notice without coming in, I would like them to work out notice if they wish to be paid. I've explained the misunderstanding and now they want to take me to employment tribunal.

Have they got a case as I feel I'm trying hard to find middle ground and am genuinely sorry for the mix up.

I can’t give free advice to an employer on here I’m afraid, you need to seek professional advice. But as a general point, if someone is willing and able to work notice they need to be paid, and if not, they don’t, so if you have a member of staff refusing to show up for work, you don’t need to pay them.

If you’ve had a tribunal claim made against you for something, or it looks like a claim is going to be brought, you need to get some advice, from a local HR consultant or solicitor. Are you able to say whereabouts you are? Either I might have a consultant in your area or someone else might know someone?
