I have for many years suffered with a bad back. It has been worse since I hurt it at work last year. Last week it was bad but I carried on regardless as I don't want to take to much time off. On Saturday at work this crate of bananas nearly tell on me. I jumped out of the way and felt my back go more. I left work early assuming I'd be okay by Monday. It was actually worse. It has since spread in to my neck and shoulders. I can hardly turn my head of lift my arms. I.I'm going to the doctor today but I'm worried work will sack me.
They aren't terribly supportive anyway but the big fear is I've only been there 14 months so a lot less than 2 years. My husband said they can't sack you because it was a work related injury. So if they sack you you can sue them. I'm not so sure. Does anyone know for sure where I stand?
Just for context both injuries were recorded by management and myself in the accident book on the same day.

Shit, sorry just read that it was.

They could still manage you out if you back means you have a pot of time off

However, of this incident was because they were at fault, I would imagine it would not be good idea to do it on this occassion.

However, if you are off again they could.

I very much doubt they cant ever manage your absence due to making your back worse a year ago.

Unfortunately it sounds like you wasn’t fit for the job in the first place if you had back problems for years. If you have had manual training and training on all the equipment then your company is not liable for bad back and you can be sacked as your not fit for the job. It’s crap I know but unfortunately it might be best for you to look for a less physical job x
