Do I complete the ET1 or can a lawyer or union f/t official do it for me?

You can do it yourself or instruct a lawyer to do it, and pay them accordingly. Have you went through ACAS early conciliation yet?

Yes and my certificate has come through. I just feel it is better for my lawyer to do it for me to avoid me making any mistakes etc. Thanks for clarifying, that is a relief.

It will be more cost effective and possibly more accurate if you can fill out the ET1 form with the relevant information about your claim, then ask your lawyer to review what you've written.

Which section/s do you think you'll make mistakes in, maybe we can help indicate what sort of information you need to include - it's a reasonably straight forward form.

You can do it yourself, but you need to be sure in particular that:

  • you get the name of the employer right and it matches the name on the EC certificate;
  • you complete at the very least all the compulsory sections which are marked with an asterisk;
  • that you include all the claims you wish to bring and that if, e.g, you are claiming personal injury as part of a discrimination claim , that you include this;
  • that you submit your claim in time - ie the original limitation as extended by early conciliation.

It would be a good idea to get a professional to help you with this.

And just to add to @Fozzleyplum's point, the submission is web based so you can't progress to the next screen unless the mandatory sections (with asterisks) have been completed.

Thanks, I'll have a chat with my union lawyer and see what they think I should do. It will be paid via my union so cost shouldn't be an issue. I just wasn't sure if it should be me or them. They just said it needed to be done so I'll get clarification.

I would arrange an appointment to agree broadly the information needed on the ET1, so you have full visibility but get them to do the heavy lifting re submission. That's what you pay your union subs for.
