Redundancy

Hi has anyone dealt with acas ? I've been made redundant and taking my former employer through early conciliation as he has even put on my redundancy letter one of the reasons was my gender !!! Now just seen he's advertising for the same job I was doing ! Wandered if Anyone has been through anything similar and there experience?

Normally, I would ask how long have you worked there, because if it's less than two years, you have few rights. However, you have the right not to be discriminated against for protected characteristics from day one, so length of service is irrelevant.

Redundancy is normally because a job role is no longer required, so it wouldn't be recruited for. Discrimination isn't an acceptable reason for redundancy and while I am not under any illusion that it doesn't happen, I am quite amazed that someone is stupid enough to state it as a reason rather than come up with some other excuse.

ACAS should be able to give you good advice on the best way to handle this. I infer you're not in a union - if you are, this is exactly the sort of thing you pay your dues for, so contact them as soon as you can.

Redundancy is always because the job is no longer required. A worker is surplus to requirements because their job is no longer needed. It’s not about the person! If they are advertising the exact same job, that’s not redundancy. Check the job description and person spec by getting a friend to “apply”. I would actually see an employment solicitor. Gender of an employee has nothing to do with redundancy. Complain loudly and get compensation. You are not being treated fairly.

As mentioned by pps, 2 separate issues here. If the same job is being advertised then you were fired, not made redundant - if you were fired due to your gender. I'd get legal advice and pursue both issues, especially if you have written proof of these.
