Taking annual leave within notice period

I was wondering if it is permitted to take accrued annual leave within resignation notice period?

Can my request to take the days I'm owed be lawfully rejected?
I have a 4 week notice period which I have already given notice of and have 7 accrued holidays owing.

it depends on the terms of your contract i think. in every job ive been in no annual leave was allowed whilst on notice. any untaken/accrued leave would be paid

it may be worth asking though if you could use the annual leave and finish 7 days earlier.

I've had the opposite experience, it's always been expected I take my annual during the notice period as they didn't like having to pay extra on top of the leave period (though it was an option if I couldn't take it).

It's at the discretion of your employer. You have no rights either way unless it's specifically covered in your contract. You have a right to be paid for the leave if you don't get to take it and that is all.

As with any holiday request, it is entirely up to the employer whether to grant it or not. Some employers would rather avoid the extra pay involved if they don’t allow outstanding holiday to be taken during notice. Other employers might for handover reasons want to ensure departing staff are in the office as much as possible.
