Hi, my daughter is due to return to work in December. She is a teacher. She was full time, but wants to return on 3 full days per week. Her head teacher has offered full time 5 days or 3 half days, neither of which is suitable. If she leaves does she have to repay her maternity pay?

Yes if she leaves she will have to pay pack her occupational maternity pay.

Yes, if you do not return you will have to re-pay it.

Thank you very much. What is the difference between Occupational and Statutory Maternity Pay?

Occupational maternity is anything over and above the statutory minimum. Her maternity policy should be clear on what the occupational/enhanced entitlement is. Statutory minimum is 90% of pay for 6 weeks followed by a basic rate of (currently) £148.68 a week.
