Paternity leave when you’ve left your partner?

Can men take paternity leave when then have left their pregnant partner and aren’t going to be supporting them or the baby? It just take extra time off work to doss about?

Probably. It can't be enforced by law.

Probably, but the partner in question would probably need the matb1 form that confirms the due date, and the mother is under no obligation to provide it as far as I'm aware.

I am neither in this situation, want to know to advise my sister. Her OH has buggered off with someone else and will prob take the pat leave just for time off which has really riled me.

Yes, in reality, because no one from his employer is going to check to make sure he is spending the time with the baby or your sister.

It does state that they have to make a declaration that they will be using the time to care for the baby and/or mother.

@RomanyQueen it’s not for me to call his employer, I’ll tell her what’s what and she can make a decision. It seems you don’t have to provide the form anyway from what people have helpfully posted which is a little surprising but clearly the case!
