Starting a new job during my notice period?

I have handed in my notice and am due to finish officially on 26th June. I have a couple of days leave to take so agreed with my manager to finish on the Friday and take the Monday and Tuesday as hol.

My new job have asked if I will start work on the 24th, which is the Monday. This would mean 2 days where I’d technically be employed by both. Is this allowed?

It is possibly technically in breach of your contract with your current employer, however the chances of them being bothered and/or wanting to stop you are vanishingly small, so if you want to do it, I’m sure you’ll be fine.

My current contract doesn't say I can't have a second job but I'm not sure about my new one I'll need to check that. I know my employer won't have an issue with it, it was just in case there was any legal reason I shouldn't do it. I had a browse online earlier and the advice was fairly conflicting!

It might screw up your tax the first month but would eventually correct

Why don't you ask your current employer if you can terminate your employment on the Friday, and ask them to pay you the 2 days accrued annual leave with your final pay check. Then you can start officially on the Monday at the new place.

I had a similar situation last year and was told I wasn't allowed to by my current employer. I had a new job and they wanted me to start in 3 weeks, I had to give 4 weeks notice but had a weeks holiday to use so asked if I could use this make it work out and HR said no. I managed to wangle a 3 week notice period in the end luckily

Thanks all.

My current employer won’t budge on the notice period. I tried that one. I’ll speak to HR about getting paid for the holidays instead and see what they say.
