Hi all,
So I’m looking for some advice really, I finished work on 23 July 2018 for summer holidays (I’m a term time member of staff), my babies due date was 16th August 2018, he arrived 18th August. If I wasn’t pregnant I would be due back at work on 3rd September. When should my maternity leave start? On my due date or the day I was due back at work? (4th september).
As if I wasn’t pregnant I wouldn’t be at work anyway and wages would remain the same.

The latest date for ml would be your edd. Surely your maternity would reflect that?

Thank you, I just can’t understand why when I wouldn’t be at work even if I wasn’t pregnant😩 I feel my mat leave should of started when I would of been coming back to work if I wasn’t pregnant. Thanks again

You cannot start maternity leave after the baby is born! Did you agree a date beforehand and hand in your matb1? worksmart.org.uk/work-rights/family-friendly-work/maternity-leave/what-notice-do-i-need-give-if-i-want-take-maternity It won't make much difference in the end though as if you take a full year you would not be actually back in work until September but paid from mid August (or earlier if you end ml sooner, ie end of Summer term)

Yes we agreed my mat leave would start on my due date 16th August, I’m just questioning it now due to someone else’s view... my 39 weeks is up on 16th of May. I’m just thinking as a term time member of staff with baby due during school holidays surely my mat leave would start when school holidays are over? As I wouldn’t be in work anyway.
