Awaiting op offered a job?

Hello,
My brother has had a minor medical condition for years which has never affected his working. In Feb this year he tripped at work damaging his condition which lead to a hospital visit and then referring him for surgery (still awaiting a date) and he took a week off work for recovery. Upon his return, they dismissed him and declared him "unfit for work" (was in the probationary period). He couldn't afford to stay off work for long and so he began applying for jobs. He's since been offered his dream job and he accepted. He's starting next week but has been asked to fill out a medical for and one of the questions are 'do you have any medical conditions that you are aware of and can affect your working' and then a declaration box to declare the information is to his knowledge. Do you suggest he tells the employer about inevitable op or just act as though he's not aware?

I'd tell them, if they find out afterwards they might just get rid of him. At least if they know he might be better protected.
Is he 'legally' disabled ?
