I work in a garage 6-10 hours per week.

My boss is hot headed and difficult to work with but we have muddled along and I've been the since July 2016.

Every so often he has a melt down. Two weeks ago I left a note on his desk asking info could take 2 days off (in effect 1 week) firstly he ignored it so then I asked him & he got really angry saying he couldn't run a business if I take holiday and the only person he cares about is the other employee who works in the workshop. He says he should just sell the business. He basically hates the responsibility & stress but takes it out on me. I try to be supportive and listen but lately it's really got me down.

Anyway in the end I said I would work one of the days if I could come in later as it was my dad's birthday when I wanted to take him for breakfast. He then said don't bother I'll manage. Today I returned and paid myself 3.5 hours holiday for Tuesday and worked 3.5 hours paying myself 7 hours. He was furious and said I was not entitled to it.. He says I can have 1 week at Christmas and two weeks in the summer and thats it. He allowed me to have the wage this week as the cheque was already written but I have to pay 3.5 hours pay next week. I don't whether to put my foot down and insist he pays me or whether to just leave. I think I should be entitled to 39 hours holiday per year. I based this on working 7 hours per week over 2 days. Can anyone advise.? He's a real bully and mostly I can deal with this but I've not been feeling too good recently tired and stressed and I dread going in as i never know what mood I'll be faced with when I go in.

You are entitled to holiday based on your hours work, he has a legal obligation as an an employer to pay you your holiday entitlement, your contract of employment would need to specify any restrictions around when you can take those days, calculate your holiday entitelment here www.gov.uk/calculate-your-holiday-entitlement

Personally I couldn't work for someone like that, lifes to short to put up with that rubbish, find a better job

You are entitled to 5.6 weeks holidays per year (including Bank Holidays). Given that you work 2 days a week that's 11.2 days, or 78.4 hours. I dont know what days you work, but any paid bank holidays will come out of that.

If you work Mondays and Tuesday, then this year you will have 5 Bank Holidays. As the other three are on non-working days you don't work (and don't get paid). You then have 6.2 days to use as you like. It's way way better not to work Mondays and Fridays if you only work 2 days a week - if you worked Wednesday and Thursday then you'd use 2 holiday days for Bank Holidays, and have 9.2 further days to take.

He sounds awful. What’s in your contract as far as hours go? There’s a good holiday entitlement calculator on gov.uk.

I don't have a contract, I work Tuesday and Friday usually 3.5 - 4 hours on those days.

Yes 7 x 3.6 = 39.2 hours leave.

Thank you for your help. Luckily I took another job on six months ago and have been building up my hours, I'm now up to 15 hours per week so I can probably leave the job at the garage . I was going to carry on until May to do the year end but mentally I don't think I can stomach it.

So today I went back to work and my boss acted like nothing ever happened. I left him a print out of my holiday entitlement and a list of holiday taken and will see what he says on friday. If he still insists on taking the 3.5 hours back I am going to give him a weeks notice.
