Maternity pay and SMP

I’ve asked a similar question before and I’m currently waiting to hear back from my employer if I’m to receive any pay from them.

I’m 3 weeks outside of the qualifying length of service for SMP however they do offer a maternity package for those who are to return to work(again 3 weeks out).

Has anyone had SMP refused but received maternity pay in a deal to return to work?

Read your contract. I suspect the answer is no. There is nothing to stop you trying to negotiate but legally they won't have to pay it.

You should be able to claim Maternity Allowance instead of SMP.

I had to work for my employer for 52 weeks prior to getting pregnant in order to quality for enhanced maternity pay. I've never heardcof getting enhanced pay if you're not even entitled to smp

Unless they really want to have you back, I doubt there would be an exception unfortunately.

My company requires me to have worked there for a year by the 25 week of pregnancy, so I have delayed my TTC plans to account for this as I can't risk getting pregnant earlier and missing out on 10k.
