maternity pay, it it 11 weeks before or 15 weeks before baby due?

hi ,was wondering if anyone could tell me,if you still get smp from boss if you leave at 15 weeks before baby due, or is it 11 weeks,? the thing is im in full time employment but it is chnaging to part time- 16 weeks before baby is due, does this mean i will not get as much maternity pay?
Is it based on the hours youve worked in previous weeks before you go on maternity leave.

in the nhs I think it is an average of 3 of your wage packets during your second trimester.

I am pretty sure it's 15 weeks (changed recently). And I think it is based on what you are paid when you go off.

i went to citizens advice and they told me 11 weeks, then i went to job centre and they told me 15 weeks, then boss gives me something printed off computer and it is 11 weeks!! i am hoping it is 15 weeks .cos then i will just have been part time for 1 week instead of 5 weeks, after been full time for 13 years!!

Hi

The confusion has come because you can leave for Maternity Leave any time starting 11 weeks before the baby is due, but you are entitled to SMP if you worked for the same employer up until 15 weeks before your baby is due.

So, if you LEAVE work at 15 weeks before you are due (ie cease employment) you still get SMP.

But, you can't start Mat leave until 11 weeks before you are due (ie 29 weeks pregnant) unless the baby is born prematurely.

Your SMP will be worked out using the 8 weeks prior to the 15th week before the baby is due, so from when you are 17 weeks pregnant until you are 25 weeks pregnant.
