I had another thread where I said that my employer were saying I couldn't go back into my old role after maternity leave 'because it had been filled'.

I went through the formal grievance process and my grievance wasn't upheld, because the reason I wasn't being given my old role is that it had been downgraded while I have been off on maternity leave due to business needs changing. This is obviously different from the original reason given for not going back into my old role.

I'm assuming that now there is a different reason that I can't go back into my new role I don't really have a leg to stand on? I don't want the new role for various reasons. Are my employer allowed to just downgrade my role while I'm off without telling me and force me into a different role?

Hi can’t help here although I’m
Going through something similar where hours and days have been changed so
I now cannot afford childcare making it impossible for me to return to that role.. I have contacted Acas who have sent me the forms for early conciliation although haven’t filled it out yet... Blush unsure of your particular circumstances but give Acas a call if you haven’t already. Good luck x

It depends how long you have been off for starters but if the role is no longer there you cannot have it. I do not have the exact wording in front of me but basically you cannot be paid less or disadvantaged by your maternity leave if you return
