Notice period on Mat Leave

I'm contracted to give 1 months notice but as I've taken enhanced maternity pay I must return to work for four months or pay back the extra pay I've received.

I have 9 months left of my leave, can I hand in my notice now and state my last working day as the last day of the fourth month of my return? Can they say 'we only require one months notice so we will accept your notice and end your contract one month from now'?

It doesn't gain you anything to resign now, and it's possible that it could cause problems so just do it a month before you want to leave and avoid the possible issues.

So you're planning on handing your notice in now to finish in 13 months' time? Why?!

They can't end your contract a month from giving notice if you are clear that you are giving more than the minimum notice and specify your end date, but I'm struggling to see why you'd give 13 months' notice. Apart from anything else, anything could happen between now and then so leave your options open, surely?!

@flowery I can't go into too much detail as it's very outing but I am currently going through a grievance process for discrimination and I am 100% sure I will not be returning due to securing a place to study at higher education. I am hoping by handing my notice in it will stop constant contact from the workplace whilst I am maternity leave and give them enough notice to fill my role.
