Mistake on my return to work date

Hello,
So my work has made a calculation for my return to work date, it did seem generous at the time but I didn’t question it. So my mat leave finished on july 2nd and they then attached my holidays and gave a return date of sept 6th, it transpires now it should have been august 6th. I however have that in writing in more than one email and forms. Now they are saying it has to be unpaid leave or i need to get back. Whose fault is it in this situation? I haven’t arranged childcare for august so can’t go back ...

I’d say you’ve enough notice that a mistake was made and knowing your mat leave (and double checking the days) is equally your responsibility. So I wouldn’t think you have anything but their goodwill to stand on.

I might be wrong though! Did you know know how much mat leave you were entitled to (not just the return date?).

That seems fair tbh. You must have known that you didn't have two months worth of holidays available to take?

Ok you are prob right buy what a pain, they are also restructuring so they are basically asking me to go back for my notice as my job does not exist any longer, is all very complicated and annoying , that seems to be part of the joys of goin back afger mat leave!!
