Term time holiday entitlement help!!

Hi there,

I work for a preschool where we cannot take holidays during term time and I just want to check my holiday entitlement is correct before I raise it with HR, so I am hoping someone can please help me.

My entitlement is based on stat mins and I currently get paid for 3 weeks, Feb half term, Last week in August and Oct half term. We have two weeks off over Christmas and don’t get paid for the bank holidays. I have tried to work this out but there is not much out there for us term time workers.

I really hope someone can explain my entitlement so that I can raise it if I am not getting the correct holiday pay.

The statutory minimum holiday entitlement is 28 days - this includes bank holidays. In your case this would be pro rated as you work term times only (39 weeks I presume?) Your entitlement will therefore be (39/52) x 28 days = 21 days. As you can't take holiday during term time, this should be taken during school hols, therefore I reckon you should receive 21 days holiday pay.
