Two issues

  1. I am the only female without an actual office. All (male) comparators in similar roles do. Is this discrimination? If I am given a much smaller office than others, is that discrimination? It cannot be argued it is not relevant to my role.

  2. I am aware of a huge disparity between my salary and my (all male) comparators. Can I ask my employer to confirm this? Can I take my employer to a tribunal whilst am still employed/ would my job be protected? Appreciate it may not be a pleasant environment in which to work but I love my job and am good at it.

The office situation isn't illegal, however it could be a useful secondary indicator that salary inequality between men and women in the company is a real problem.

Yes, you could take your employer to Tribunal, but I would focus on resolving the matter internally. Give them facts and data, ask them to address the disparity in salary levels.

They could find any reason they like to dismiss you (even make one up) if you don't have 2 years' unbroken service which gives you statutory employment rights. With more than 2 years, they'd have to follow disciplinary / capability process which takes a lot longer and is more complex, so in short you'd keep your job, but could find it all getting very uncomfortable and stressful. And think about the difficulty of performing your day job, while having to give headspace to a Tribunal case.

If they dismiss her for asking about this I think she'd have good grounds for a discrimination claim!

Thanks to all, I'm going to approach my employer with a few questions but am also speaking with and employment lawyer to put a case together (many examples of discrimination, not just the office), as suspect talks will be brushed aside as my employer no good at dealing with issues. 🙁
