Not been paid, need advice!

I’ll try to keep it short!

I haven’t been paid correctly since October. I worked till the end of November, after which I went on maternity leave. We get paid on the last working day of the month, and when I checked my account at the end of November I’d been paid some random amount (think £200 as opposed to £1750). Told my line manager who said they’d sort it.

Nothing has happened since. I’ve emailed a few times, and tried to call, but I’m not getting any response. My payslip is weird. It doesn’t state any reason like hours worked for the random amount. Then the same thing happend in December for around £200. But I shouldn’t be receiving anything from them at all as I’m not entitled to SMP. I got in touch again earlier this week, explaining about the fact I’m still owed money, and being paid random amounts as I’m equally concerned that it’s money I shouldn’t be getting!

Does anyone have any suggestions? It’s making me really anxious and it’s the last thing I need with a poorly newborn to look after Sad do I need to give them longer to sort it seeing as people may not be back at work yet?

Unless it's a teeny company I'd expect them to have someone back in the office who can help by 5th Jan.

Does your pay slip have anything at all written in the payments column? Is the tax figure in the deductions column a negative number or does it have an R next to it?

I'm wondering if they've stopped paying you completely and the money you're getting is tax rebates. (Not saying that they're right to stop paying you but it would explain the payments you're actually receiving).

What date did you start mat leave and what date do you get paid? Last day of the month for previous month? So pay on 31st Oct was definitely Oct's pay?

It’s a huge organisation, payroll operates from head office but it’s processed by line management at various locations if that makes sense.

There’s nothing at all in the pay and allowances section, the deductions are a minus figure so -£200 net pay £200. But would this be the same amount two months running? I’m just worried that this is money I’m not entitled to, but if no one will answer me how am I supposed to know?

Payroll runs from the 1st-last day of the month. So the 31st would be October’s pay. I started maternity on the 27th of November, so it should be roughly one months pay.

Sounds like they are leaving you on the payroll as you might return and they are not actually paying you but your payslips are being adjusted for tax owed back to you - does that make sense?

If you are not entitled to SMP but still on their payroll -200 most like means that system expects you to earn nothing until 5th April 2018 and therefore earnings you received so far during this financial year been taxed to much ,system allocates untaxable allowance evenly throughout the year ,providing you earn money.Now as you stopped earning refund is due to you as you earn less then expected for the full year.
But that doesn't include your earned wages from 1st Nov until 27th Nov,it has to be paid.I suspect your line manager messed up and not provided correct information to HR/payroll office on time.

That’s such a relief! I set aside both months money because I was afraid it wasn’t mine to spend Blush

So I guess my question is now, is there anything I can do to get them to pay me my wages? I just feel like they had all of December to sort it and are avoiding me on purpose.

Yep as above, it's only the missing Nov pay that's the issue, dont worry about the tax as that will sort itself out when they process your arrears and you'll likely continue to get rebates through to March as you'll be on nil pay.

I'd get onto payroll now (even at half 4 on a Fri!) to find out exactly what info they received re your mat leave dates and go from there. I'd also be chasing up your manager, persistently. If it's a matter of incorrect dates provided to payroll then 6 weeks is a ridiculous amount of time to have to wait for a resolution.

I think you need to contact them again, copying in everyone you can and tell them you will take legal advice if it is not sorted out within say 14 days

Email the central payroll dept directly and cc in the HR manager and your line manager.

Called work, line manager conveniently unavailable. The receptionist ‘couldn’t find’ the contact email for our payroll clerk, or a number to call Hmm

I figure I’ll try again Monday. If not, I’ll be calling the customer head office number until someone transfers me to the right department!

Tell them to get their finger out or you’ll be raising a claim for unlawful deduction from pay.

Well ... two months after posting this I STILL haven't been paid. So reviving this thread for advice.

My manager is blaming Head Office, says she emailed the bloke responsible for authorising payment months ago. I've chased it so many times I'm losing the will to live and just don't have the strength to deal with them anymore. I rang again yesterday, and still nothing in my account.

So what do I do now? Because I'm beyond pissed off that my wages have been withheld since I started maternity leave.

You need to download and fill in an N1 and then send it to them with a letter stating that if you have not been paid by x date ( I generally give them seven days) then you will be lodging the attached paperwork at your local county court.

I would by-pass your Manager and the bloke responsible for payment and go to the top man/woman CEO etc and give them all the information and insist that it is sorted pretty dammed quick.I have never be afraid of approaching the big wigs when it concerns my income /unpaid wages etc so take the bull by the horns and get in touch with them.Good luck

If you certain of all your facts you could go to a tribunal:

Perhaps a letter/email to the top HR person first but making clear that it the route you will take if it is not resolved by a given date that you choose.

If you intend to take this matter to employment Tribunal make sure you pay attention to the deadline. You must have lodged the claim, at least 3 months less 1 day from the last time your employer failed to pay you correctly.

If your claim only relates to November, then unfortunately you are out of time. If your claim is for ongoing amounts including Nov but also more recent months then you could still have time.

If you are planning to write to HR, remind them that you intend to lodge a claim at Tribunal unless they sort things out, and cite the 3 month deadline that enables you to do that. Hopefully it will sharpen they attention to sort the matter out!

Too late for a tribunal. My November pay was my last working month as I'm on maternity leave now! I'm sure someone must have put the wrong date on my paperwork somewhere along the line.

I'll be calling them as soon as I'm back off holiday Sad I tried to email the regional manager and the HR director last night but their emails no longer work, a colleague has told me both have left since I went on ML, but isn't sure of the new people's names.

I just feel like this is so deliberate. I think they hoped I'd be distracted by a new baby Hmm

And Lobster I wish I was kidding. Obviously the fact I'm nearly 2k short is having a huge knock on effect. The credit card has taken a battering 😩
