Going back but not giving up Maternity Leave

I'm going back to work today but I'm not giving up my additional maternity leave. One of my close friends at work was expecting but she lost her baby at the end of last week. She was twenty five weeks pregnant. I've agreed to go in and work a couple of days for the next three weeks to cover holidays.

Is this allowed?

I said I wasn't going back until November.

I do not the rules, but seeing as no-one else has posted, I'd say be very careful because the minute you start work again they may be able to say you've gone back and deny you the AML.

I think you need to look at any paperwork you've got and maybe look at the dti website. There are rules about working while on maternity leave and I can't remember whether they apply to the statutory leave/pay or the occupational bit or both.
If you are out of the paid bit of your leave I guess it doesn't matter anyway. Be careful though and check it out first - ask your personnel people.

Flip - Have no idea about your problem - but does your friend know that she is entitled to full maternity leave - we were told with my sister that you do if you lose the baby after 24 weeks.

Pretty sure that you can't do this.

My boss asked me to do some work whilst I was on maternity leave, just some training, and he had to try and work out a way of paying me as I was only half way through my maternity leave. In the end we settled for a few days when I'd take holiday and he'd turn a blind eye, and paid me a bonus for the others.

You might want to look through this but I couldn't find anything that talks about going back for just one day.

Give the CAB a call if not your personnell department should really know this.

As its additional maternity leave I think you are OK so long as you get your employers to put in writing that you can still have your AML after these couple of days.

You are not allowed to work whilst receiving statutory maternity pay, even for half a day as this is a government paid benefit but this will have ended if you are on AML.
