Mat leave and holiday pay question

Hi
Does anyone know if I hand my notice in whilst on maternity leave if that affects the amount of holiday pay I would get.

I don't have any enhanced maternity pay so won't have to pay anything back there.

It's a long story but I basically am not going back and would rather tell them now but I won't if it will affect how much I get.
I'm due back in October.

As far as I'm aware you will be entitled to holiday pay up to your official leaving date.

If you are due back Oct, you must notify them 8 weeks prior of a date change, so I would imagine it would be the same for leaving too. You will then agree a notice period. The amount of annual leave is from the start of you annual leave year up until the end of your notice peripd (minus any you may have already used).

You should get your holiday entitlement up to the date you officially leave. I only need to give 28 days notice to change my return date so I'd check what you need to do with your company.

You need to give 8 weeks notice if you are changing your return date, but if you are handing your notice in, then the length of notice that you need to give is whatever is in your contract.
You will get paid for holidays accrued up until your last day of employment.

What Ellypoo said, so the longer you leave it the more you get. Hence my notice terminating 4 days before I was due to go back (plus I was waiting to hear if I'd got on my course).

As long as you are clear that your termination date is the last day of your maternity leave, you are perfectly entitled to be helpful and give more than your contractual notice period.
