Holiday pay whilst on mat leave

I am due to go on maternity leave at the beginning of August and I've asked my employer if I can use my remaining yearly entitlement of holiday before my mat leave kicks in. For some reason they have only calculated how much holiday I'm entitled to until the end of July, but surely I still accrue holiday whilst on mat leave so they should let me have the whole 28 days?

I understand I won't have accrued these days yet, but if I've read the government website correctly I can take these days either before I go on leave or at the end of the year. Can anyone confirm?

Is the issue that you don't have time to use all of your annual leave before your due date? Your mat leave has to start at the time if your baby's birth by law.

Zebra may be right. How many days do you have left in this leave year that you want to take and how many days until your EDD?

You accrue throughout maternity leave, yes, but that doesn't mean your employer is obliged to let you take it all before you go.

Sorry, I don't think I was very clear in my post! My question is that if my employer has only calculated my holiday entitlement until I go on mat leave, what happens to the holiday I accrue whilst on maternity leave? When would I get paid for those days? It was my understanding that I could use my full years entitlement even though I haven't accrued it yet.

You can usually add holiday onto the beginning or end of maternity leave

Probably best to ask them how they've calculated it

I got my holidays that I accrued during mat leave just before I was go back. So say i was due to back on the 1st. I went back 4 weeks later I couldn't take them before my mat leave because a new year started while I was on mat leave

What we do (NHS) is that you take everything you've accrued before your leave date, before you go. When you return you take the rest of your leave before you actually come back. So:

Your leave year runs April to march. You go on mat leave on 1st September. You take your annual leave fir April to August inc before then. You take a years leave so you return on 1st September 2018 but actually you then take a full 12 months leave so you're back in the office 28th September or whatever.

Your post was perfectly clear. As I said, you do continue to accrue holiday throughout your maternity leave, but your employer is not obliged to let you take it all in advance.

If they won't let you take it in advance, you'll need to probably tack it on to the end of your maternity leave. That's what most people do.

But ask them when you can take it.

My employer has an annual leave year than runs January to December and employees can't carry any days over.

Both times I've been on maternity leave I've had to use all of my holiday for that year before going off - i.e. my full year's entitlement. In both situations I was going to be off until the next year.

When I came back in the following year I then had my full entitlement to use in that year too.

So I agree with you that it doesn't sound right. I'd ask them about the rest of your year's entitlement.

I was able to use what I hadn't accrued yet. Same with normal AL I'm taking 3.5 weeks in the summer and I don' have that much yet! I would have to pay it back if I left though.
