I work for a "UK company" which is has its head office in the UK but I have been based in Madrid since I started. I got pregnant (unplanned) almost as soon as I started, which was last year August, and gave birth in May. I pay taxes in Spain, but make my NI contributions to the UK, hence my employer pays for private healthcare for me here in Madrid. Some staff are given spanish contracts which means the pay social security here in spain, whilst others like me have "UK contracts". In the staff handbook it states that UK employees will receive statutory maternity pay. I started maternity leave halfway through the month, I had worked two weeks full time, however when I received my salary I was paid 500 euros, on my payslip it states family allowance. I have no idea what that is, how it has been calculated, my net salary is usually 1900 every month. I contacted HR after being sent back and forth, they said something like because I started maternity leave partway through the month, my pay was a lot less, I tried to explain that I expected to receive my full salary for the two weeks I worked then maternity pay for the next two weeks, HR still concluded the payment was correct. I then received an email stating that they had checked HMRC and the staff handbook and nowhere did it say anything about statutory maternity pay, that could I forward them details of how it worked. HR also told me next month(June) I would receive my £1900 salary, I left it as I assumed this would make up for the shortfall. I have now received no salary this month, and chasing HR again to find out why. In addition to this another lady who was pregnant at the same time as me but on a "spanish contract" gets 16 weeks full maternity pay, which is completely unfair since she does the same job as but just happens to be on a spanish contract. This has all coincided with me separating from husband who was violent towards, and having an awful cesarean, I am so stressed,. Please any advice is appreciated.
