Are they paid below NMW with the commission then used to take them to/over the NMW please?

I don't know anyone who sells used cars but this is legal. Workers do not have to be paid the minimum wage for every hour worked but they must be paid at least the minimum wage on average over each pay period. Note that, if they earn commission in, say, April but it is paid in May, that commission is still counted as part of their April pay for NMW purposes.

Note that if the sales person does not earn enough commission to take them to NMW the employer must make up the difference.

Thankyou - that is so helpful!

I read it is legal (which surprised me) and read about 'double counting' but didn't know the employer us obliged to make it up.
