Employed and self-employed - maternity leave.

I hope someone can help, or point me in the direction of more information.

I am both employed and self-employed. I work for the LA 30 hrs a week, and then tutor from my home 10hours a week. (My contract at the LA allows me to do this)

Can I continue to tutor while receiving SMP from my employer?

Obviously it's face to face, and it's taken me a long time to build up my reputation so I don't want to loose all that, or let the children down.

I was in the same boat 3 years ago and you couldn't do it then. Although mine was the other way round. I was employed but only a few hours a week so not enough to be eligible for SMP so I claimed Maternity Allowance in relation to my self employed work. I wasn't able to work any days for my employer without it cancelling my Maternity Allowance.

I've found that info on Mat allowance, but don't intent to claim this. I'm sure I read that SMP is different for some reason!

SMP is claimed as an employee. You would only lose your entitlement to SMP if you returned to work as an employee.

Even if you had two jobs as as employee, you can still return to one without it affecting your pay for the other.

So there's no reason for you to stop tutoring maybe have a few weeks off at least, though!

Could you please help me.
I am filling the documents for Maternity Allowance.
I worked as employed (just for few hours weekly) and as self-employed (I have paid my NI contributions).
I earned just £300 as employed and I am not eligible for SMP.
I would like to apply just as self-employed.
Should I send SMP1 form and 13 payslips? I believe if I send those documents, I will receive the smaller amount (£67).
How did you get the full MA amount as self-employed?

If you have paid all your NI during your test period then you qualify for the full amount of Maternity Allowance :) You shouldn't have to send in any payslips to claim MA as self employed.
