Would this be discrimination?

I am currently on mat leave and due to return to work in August so in 5 months' time. I am applying for a more senior role at my company and it's a position that I think they want to fill ASAP.

Am I right in thinking that the fact that I am on mat leave and not returning to work for 5 months shouldn't affect their decision over whether or not to give me the job - if they did would that be unfair discrimination ? Or are they entitled to make a decision including the practicalities of taking up the role in time.

Any thoughts or knowledge much appreciated !

I have no expertise at all, but I think if they need the post filling asap it would be reasonable to expect the applicants to be available now. Can you not end your mat leave sooner?
