Redundancy - DH screwed by employer. Can any employment experts advise?

Would be immensely grateful for anyone who has any expertise on this. DH has been made redundant by his company who have gone into a CVA (this appears to be a totally cynical move by a company director who just did the same thing to another company). He has worked there just under two years and has just received paperwork which appears to say that he will not receive his final pay-cheque, let alone the two months notice he is entitled to. We know that the government will pay up to £475 per week if he doesn't find a new job but we are, frankly, fuming that the company is going to just get away with this and the director is going to be able to continue running companies.

Do we have any comeback at all? He's owed the best part of £7k before tax.

I think you need to post this in legal matters rather than employment because, presumably, whatever the reasons for the CVA, I imagine it would 'trump' any rights to notice pay etc. I'm guessing you should ask an insolvency practitioner.

Incidentally, are you sure his contract says he's entitled to 2 months notice? That seems incredibly generous for less than 2 years service.

Hi Confused - thanks for the tip. I will repost there too. Thank you. Yes, as far as I can tell from all of his paperwork, he is entitled to 2 months (it states that in the CVA confirmation too).

I realise that this is one of those "sometimes life isn't fair" lessons but I can't stand the thought that this guy is just going to get away with it. Particularly since there's another employee who is on honeymoon and is going to come back to no job and no pay.

Tough that is awful! How do people have such brass neck apart from anything else?! I wouldn't be able to sleep at night! Thank you for the contact details though, we'll definitely speak to them.

I think he deliberately misled DH about the state of the company (DH was going to look for a new job six months ago because he was worried - he stated his worries to the director who told him it was all going to be fine). However he may simply be a total idiot. If that's the case I still don't think he should get to run any more companies.

Hope your DH is all sorted now.
