Annual Leave and Bank Holiday help please?

My working days are Wednesday, Thursday, Friday and Saturday. I occasionally so more to cover sickness and holidays, but those are my set days.

By my calculations my holiday allowance should be 22.4 days. (4 x 5.6 as per the .Gov website.) My employer has worked out my holiday entitlement to 16 days. I believe this is because all full time staff have Bank Holidays taken as part of their annual leave, and the same has been done for me.

I can understand good Friday, but surely the other 5 Bank Holiday Mondays shouldn't be taken out of my annual leave since I don't actually work them?

Can anyone tell me who is correct please?

No, we are in the process of appraisals and new contracts so I will bring it up then.

I am fairly sure that Bank Holidays have caused the confusion, I just wanted to make sure I was right before I bought it up.

You are entitled to 22.4 paid days off. The number of bank holidays you get off (and are paid for) might vary each year depending when Christmas and New Year fall, but 16 days holiday is too few.

Yes, I can see what they have done.

FTE are entitled to 28 days, but have to take 8 bank holidays from that leaving 20 days for them to choose.

You are entitled to 22.4 days, and the number of bank holidays within that will change by year depending on which days Christmas and New Year fall on, but in 2016, for example, 2 of them are Friday so you would have 20.4 days in 2016 to choose how you use.

He's simply taken the FTE 20 days and pro-rata'd that, which is incorrect.

Just a quick update to say thank you all very much for your advice - I have just been awarded an extra 6.5 days holiday for this year. Smile
