Part-time workers not getting leave plus bank holidays-full timers are!

Hi all,

I wondered if anyone has come across this before. Before going. Part-time, my leave was x amount of days, plus bank holidays as paid leave.
Now I'm part-time, it's been pointed out to me that although I get a pro-rata equivalent of the days leave I had before (so all fine there), I have to take bank holidays out of those hours as I work on a Monday.

I wasn't expecting this-this means that I only have half of my leave when I actually want to use it.

I wasn't expecting to not have the benefits I had before, just because I'm part-time. The other part-timers can't work on a Monday and now I'm wondering if this is why?
Does anyone know what my options are? -work different days that week?

If your bh were not pro-rated then you would have more time off than your colleagues. If you change your day, your bh will still be pro rata.

When you say you get the leave you had before pro rata, did the initial figure include bank holidays?

Hi I used to have this situation. The pro rata for the bank holidays may also have been added to your leave entitlement too. So if you are exactly half time for example you would have to take the whole day from your leave.

In those circs I did used to work a different day on a week containing a bank holiday. In fact at another place I worked it was done that way instead - you make the hours up.

You have to remember that you are not entitled to a full day for bank holidays so you have to pay that time back somehow either by taking leave from your normal entitlement or working it back if your employer allows you. Xmas and easter can be tricky!

I'm part time and got six weeks leave when I was full time. I now get the same equivalent in hours plus some leave I have to take on bank holidays. We all get a different amount depending on how many hours we work. People do click if they don't work a Monday (I do) because they don't need to take as much.

But not all BHs are on a Monday so unless you only work 1 or 2 days a week and one of those days is Monday (in which case I think your employer should allow you to choose to work an alternative day that week) then it generally works out over a 12 month period.

I am PT and we have this system and although it has its faults is far fairer than the alternative which discriminates against PT workers who don't do Mondays

This is the way it's supposed to work.

If, say f-t = 22 days leave plus 8 BH = 30 days and you work 3 days per week, you get a total of 3/5 x30 days = 18 days in total, which also cover bank holidays. You're getting the same number of days off (prorata).

If you had all the BHs you'd be getting more than your share.

Sounds absolutely the norm, it takes a while to get your head round but it is fair.

Say you work 9-1 everyday, if you had a full bank holiday off you would be paid 9-5 even if you've never worked it.

So you get the 9-1 bank holiday tagged to your annual leave total at the start of the year and use it for bank holidays.

Yes I think it makes a difference when you usually work a full Monday but are not full time - so if you work m, t, w. because then you would only be entitled to 3/5 of a bh Monday. You need to take 2/5 out of your leave or work an extra 2/5 to pay it back. My dp works a 4 day week and they dont bother with this. He has Fridays off. He gets full bh Mondays and doesn't bother about it if there is a bh on a Friday. Overall he gains from that.

I feel I get more days as I get 4/5 of my hol days then added to that 4/5 bank hol but I often work extra or bank hols so get to use the days I should for a bh on another day

It depends whether you're actually getting enough leave.

If full timers get 20 days plus 8 bank holidays, that's a total of 28. You should get a pro rata amount based on that total.

So if you work 3 days a week, you should get 28/5x3=16.8 which should be rounded up to 17. That includes your pro rata bank holiday entitlement so yes you will need to use up holiday days when you are off on bank holidays.

If they've just pro rated the basic 20 days rather than the whole 28 but are still expecting you to use some of that on bank holidays then that is unfair.

It used to be that part timers, who worked Monday, were better off as they actually got more time off than those part timers who didn't work Monday. This was before pro-rata allowance was introduced.
Monday is now the worst day to work if you are part time as, although you receive BH allowance pro rata, you lose each BH Monday from your allowance and some of your annual leave.
You need to change from working a Monday to another day. A lot of schools are shut for teacher training days on a Monday (after a school hol). This is another reason why I don't work on a Monday.

It used to drive me mad the other way. My colleague worked Mon/Tues/Weds and I did Weds/Thur/Fri. We did the same number of hours. As she worked a Monday she got all the BH Monday's off...I only got Good Friday!!! So, she ended up with 7 more days off a year than me.
She now has to use annual leave to have all the Monday's off - haha!

Dh used to be jobs are 50:50 before the rules were reformed, and the other person doing mon-wed got all the bank hols and it was massively unfair.

Op if the bank holiday Mondays come out of your annual leave allowance then the allowance ought to be pro rata (fraction of the week you work)x(a full time worker's number of days off per year INCLUDING bank holidays) it is illegal for pt workers to have ts&cs less favourable than ft workers.
