Statutory sick pay and enhanced sp

Hi I'm on sick leave until the 22nd. I used the online calculator to determine my ssp do I get this as well as any enhaced my employer pays or instead of. I'd i get just enhanced items my employer can deduct my course fees from it as its my final salary if I get ssp they can't deduct. It leaves me down 336. Can I dispute it as I want the ssp.

My understanding of it is that the ssp made up an element of the enhanced sick pay and this element your employer was able to reclaim from the government

I know this reclaim element stopped in the last tax year so I'm not entirely sure how it would work with enhanced sick pay but would assume that if you are entitled to enhanced sick pay under your contract then that's what you will get and there is no choice in the matter

If you are concerned about deductions from your salary can you talk to hr about this and come to an arrangement about reducing them for the period of sick leave

No they have already worked it out. They are paying enhanced and deducting over 2k. Leavings with nothing when in fact ssp would give me 336

I've sent emails to my line manager can I not prove they only paid enhanced in order to recover my course costs?

Well the law says that I cannot be given less thAn ssp so whilst they can pay more they cannot deduct any fees or what I owe them from the ssp amount.

As far as I'm aware they're allowed to make permissible deductions from SSP including overpayments. If they're contractually entitled to make deductions for owed course fees then they can make those deductions from SSP.

Happy to be corrected if I'm wrong but that's certainly my understanding.

They haven't overpaid. I've checked all the legal jargon and the minimum im entitled to is ssp also Acas told me they can't touch any ssp.

You are right they can take it all and leave me with nothing not a penny to pay my rent or anything yet I had to leave because they pushed me that far I had panic attacks at my desk
