Possible breach of Data Protection

I'm looking for some advice, I'm pretty sure I know the answer but I'm hoping for some clarification.

A bit of background, I'm having several issues at work and have had time off with work related stress. I have lodged a grievance against my line manager in February it's still not resolved and my line manager is now going out his way to be a complete arse.

Anyway, I have gone to get my personnel file to update sickness absence and put in a holiday request and the file is missing. I have searched the office (very small workplace)and it's not there. I suspect my line manager has taken it home. I am pretty sure it breaks Data Protection, any thoughts?

Thankfully I took copies of everything before I went off with work related stress

How would it break Data Protection? Presumably he is entitled to access your file?

It would break Data Protection if he allowed someone else to read what's in there (eg his wife) while he has the file at home, but it's no different to taking the information home on a laptop.

He is entitled to but I was under the impression it had to be kept in a locked filing cabinet?

I'm guessing he would discuss with his wife but no evidence

It's probalby worth checking, but you'd need to be able to prove he was careless with the information. He may well have put it in a locked cabinet at home.

People take confidential information home all the time to work on.
